This page applies to walherring.com and all courses, programs and downloadable resources offered by Kyle Herring, professionally known as Wal Herring, trading as Coaching (ABD:99601172706).
Wal Herring holds an MSc in Nutrition and a BPHEd, and provides nutrition, lifestyle and movement education and coaching for women in midlife. Wal Herring is not a medical practitioner, is not registered with AHPRA, and does not diagnose, treat or manage any medical condition. Note: the title "nutritionist" is not a legally protected title in Australia, so this statement of qualifications and scope matters more than it would for a registered health profession, it's how clients and regulators know what you actually do.

This Privacy Policy is prepared in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Because health information is collected as part of providing coaching services, this policy applies regardless of business turnover, the small business exemption that some other businesses can rely on does not apply here.
Personal information is used to deliver the service you've requested (emails, course access, coaching), process payments, and respond to enquiries. Health information is used only to personalise coaching and program advice and is not used for any other purpose without consent.
Information is shared only with trusted third parties who help deliver the service, such as an email marketing provider Kajabi and payment processors. These providers are contractually required to keep information confidential. Personal information is never sold. Information may be disclosed where required by law.

Reasonable steps are taken to protect personal information from unauthorised access, misuse or disclosure, including for any sensitive health information collected. No online transmission can be guaranteed completely secure. Any changes to this Privacy Policy will be posted on this page with an updated date.
By using this website or purchasing any product or service, you agree to these Terms and Conditions.
Wal Herring provides nutrition and lifestyle education, coaching, courses and related content (the "Service"). Content is subject to change and, while every effort is made to keep it accurate and current, no guarantee is given that it is complete or error-free.
Joining a free resource or newsletter requires an email address. Purchasing a course or coaching program may require additional details such as your name and address. You agree that any information you provide is accurate and current, and that you won't impersonate another person.
The Service is for lawful, personal use only. You agree not to post or transmit material that infringes another person's rights, or that is defamatory, abusive, or otherwise unlawful.
An order confirmation will be emailed on purchase. If anything in that confirmation looks wrong, let me know as soon as possible so it can be corrected.
All content on this site and within any course or program, including written material, videos, frameworks (including RISE, STAC and the 1-2-3 Meal Guide), and templates, is owned by Wal Herring. You may not reproduce, distribute, resell, or create derivative works from this content without prior written consent. Breach of this clause may result in immediate removal from a course or program without refund.

These Terms and Conditions may be updated at any time. The date at the top of this page reflects the most recent update. Continued use of the site after changes are posted means you accept them.
These Terms and Conditions, together with the Privacy Policy and any specific course or program terms, form the entire agreement between you and Wal Herring / Coaching in relation to the Service. If any clause is found by a court to be invalid or unenforceable, that clause is severed and the remainder continues in full force.
If you have a concern, contact wal first so it can be resolved directly. Where a dispute cannot be resolved this way, both parties agree to attempt mediation before pursuing court proceedings, without limiting either party's right to seek a remedy under the Australian Consumer Law at any time.
All content on this website, in the blog, on social media, in emails, in any quiz (including Perimenopause Decoded), and within any course or coaching program, is for general educational purposes only. It is not personalised medical, dietetic or exercise advice, and does not take your individual health circumstances into account. It is not a diagnostic tool and does not assess, diagnose or treat any medical condition.
Where movement, exercise or activity guidance is provided, you should consult a doctor before beginning, particularly if you have an existing health condition, injury, or are experiencing symptoms of concern. Stop any activity immediately if you feel pain, dizziness, or discomfort and seek medical advice. By taking part in any exercise or movement guidance from this website or any program, you accept the inherent risks involved and agree to work within your own physical limits.
You should consult a qualified medical professional before making changes to your diet, exercise, supplement use, or lifestyle, particularly where you are experiencing symptoms that concern you. Do not delay seeking medical advice, disregard medical advice, or discontinue any medical treatment because of information received through this website, a quiz, or a coaching program. If you are experiencing a medical emergency, call 000 immediately.
Before beginning 1:1 coaching or RISE Intensive, clients complete a health history and screening questionnaire. This helps identify anything that should be reviewed by a doctor or allied health professional before proceeding, and any area outside the scope of nutrition and lifestyle coaching (including but not limited to diagnosed medical conditions, disordered eating, pregnancy, or medication management) will be referred to an appropriate professional rather than addressed directly.
Coaching and course guidance is not provided, and will be declined or paused pending medical clearance, where a client discloses a diagnosed eating disorder, is pregnant or breastfeeding, has a diagnosed chronic or complex medical condition, or is seeking advice on medication changes or interactions. These fall outside the scope of nutrition and lifestyle coaching and are referred to an appropriate medical or allied health professional.
You agree to provide complete and accurate information about your health history, medications, and any relevant conditions when engaging in coaching or a program. Advice given is based on the information you provide, and no responsibility is taken for outcomes arising from incomplete or inaccurate disclosure.
Content and coaching are based on current research and professional experience, but individual results vary depending on health history, consistency, lifestyle, and individual physiology. No specific health outcome is guaranteed.
Testimonials shared on this website or in marketing reflect individual experiences and are not a guarantee that others will achieve the same results.
By using this website, a quiz, or any coaching or course service, you acknowledge that you are responsible for your own health decisions, that you will seek appropriate professional medical advice before making significant changes to your health or lifestyle, and that you will not rely solely on this content for those decisions.
Course fees are payable in full at the time of enrolment unless a payment plan has been agreed in writing. Access details, including any expiry or access period, are set out on the individual course or program page. Enrolment grants access to one person only and may not be shared or transferred.
Nothing in this policy limits your rights under the Australian Consumer Law, which cannot be excluded. Where a course or program is not delivered as described, or is not fit for its stated purpose, you are entitled to a remedy under the ACL.
Outside of those guarantees:your chosen refund window 30-days, no refund is available once more than 20% of course material or coaching session have been accessed or completed. This should be confirmed with a lawyer and stated clearly on each course sales page, not just here.
Where a course or program includes live calls, group coaching, or an online community, participants are expected to engage respectfully. Behaviour that is abusive, harassing, or disruptive to other participants may result in removal from the group element without refund.
Corporate wellness engagements and speaking arrangements (including Menopause & The Workplace) are governed by a separate written agreement with the engaging organisation, not by these Terms and Conditions.
To the maximum extent permitted by law, Wal Herring is not liable for any loss, damage, injury, or adverse outcome arising from use of this website, any quiz, coaching program, course, or associated content, including where that use is contrary to the disclaimers set out above.
Nothing in these Terms and Conditions excludes, restricts, or modifies any consumer guarantee, right, or remedy available under the Australian Consumer Law that cannot lawfully be excluded. Where liability cannot be excluded, it is limited, to the extent the law allows, to the amount paid for the relevant product or service.
Wal Herring is not responsible for the availability, accuracy, or privacy practices of any third party website linked from this site.
You agree to indemnify and hold Wal Herring / Coaching harmless against any loss, damage, cost, or claim arising from your breach of these Terms and Conditions, your misuse of the Service, or your reliance on general content or coaching guidance in place of appropriate individualised medical advice, except to the extent that loss arises from Wal Herring's own negligence or a failure to meet a guarantee under the Australian Consumer Law.
